AI Learning Tools: Important Information
*Version 1.1 · Last updated: 5 October 2026*
Between the Lines with Danielle provides AI Study Partner, AI Explain in your chosen language, and AI essay feedback as learning aids. Responses are generated by artificial intelligence. They may be incomplete, inaccurate, inconsistent or out of date; an explanation in another language may miss a nuance in the English original.
AI responses and indicative essay marks are not official answers, examination-board decisions or personal marking by Danielle. They do not guarantee an examination grade, university admission or any other outcome. Check important claims, quotations and interpretations against the original text, the current official specification or mark scheme, and your teacher's guidance. Write and submit your own work in accordance with your school and examination board's rules on AI use.
To answer a question or explain or mark a passage, we process the material you submit with the relevant study content. Do not include sensitive personal information unless it is needed for the request. Our [Privacy Policy](/legal#privacy_policy) explains the processing and your choices. Usage limits and eligibility vary by feature and are shown in the Service.
These tools support learning and do not replace a qualified teacher. We aim to provide the Service with reasonable care and skill. Nothing in this notice excludes rights or remedies that cannot lawfully be excluded. Please also read our [Terms of Service](/legal#terms_of_service), especially Section 10.

PRIVACY POLICY — "BETWEEN THE LINES WITH DANIELLE"
Version 1.3 · Last updated: 5 October 2026
1. ABOUT THIS POLICY
1.1 This Privacy Policy explains how Danielle Lam, operating in her individual capacity as Between the Lines with Danielle ("the Operator", "we", "us" or "our"), collects, uses, discloses and protects personal data in connection with the website at daniellenglish.com (the "Site") and the "Between the Lines with Danielle" subscription study platform for IGCSE English (the "Service").
1.2 We are committed to handling personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong (the "PDPO") and its Data Protection Principles. This policy is provided in line with our openness obligations under the PDPO.
1.3 In this policy, "personal data" means data relating to an identifiable living individual, as defined in the PDPO.
1.4 The Operator is the data user responsible for the personal data described here. Our contact details are in Section 15.
1.5 The Service is used by students (who are often minors) and by parents and guardians, in Hong Kong and internationally. Please read Section 5 (Children's and Minors' Data) carefully.
2. SCOPE
2.1 This policy applies to personal data we collect through the Site and the Service, including when you browse, register, use free lessons or AI tools, purchase access, submit work, book teaching or personal statement support, exchange service messages, or participate through a school.
2.2 This policy does not apply to third-party websites or services that we link to or that you choose to use (for example, payment providers); those are governed by their own privacy policies.
3. PERSONAL DATA WE COLLECT
3.1 Depending on how you use the Service, we may collect the following categories of personal data: (a) IDENTITY AND CONTACT DATA — name, email address, and (where you provide it) other contact details; for Minors, the relevant parent or guardian's details and the Minor's name and study information. (b) ACCOUNT DATA — login credentials (stored securely), account settings, and your relationship to any Minor user. (c) PAYMENT-RELATED DATA — order and transaction identifiers, purchased Packs, amount, currency, payment and refund status, payment reference, payer/receipt email and details needed to reconcile your purchase. Card and wallet details are entered directly in Stripe-hosted Checkout; we do not collect or store your full card number or card security code on BTL. Stripe processes payment details under its own privacy notice (https://stripe.com/privacy), including for payment processing, fraud prevention and its legal obligations. For PayMe/FPS we may collect the transfer name, amount, date, reference and any confirmation you send us to verify payment. (d) USAGE AND LEARNING DATA — the Packs you access, your activity within the Service, practice questions attempted, and progress information. (e) SUBMISSION DATA — practice essays and other text you submit for AI Feedback or Tutor Review, and the feedback generated. See Section 7. (f) TECHNICAL DATA — device, browser, IP address, approximate location derived from IP, and similar technical information, including via cookies (see Section 11). (g) COMMUNICATIONS DATA — messages and correspondence, including booking messages and staff-room messages where relevant to your role. (h) SCHOOL DATA — school affiliation, role, class assignment, school licence access, learning progress, quiz results, saved essay attempts and teacher feedback. School coordinators and assigned teachers may see the records needed for their roles. Your school may also hold its own copy of data provided to it under its own policies.
3.2 You do not have to provide personal data, but if you do not provide data we need (for example, to verify payment or operate your Account), we may be unable to provide the Service or parts of it.
4. HOW WE COLLECT PERSONAL DATA
4.1 We collect personal data: (a) directly from you — when you register, pay, submit essays, or contact us; (b) from a parent or guardian — where they register or contract on behalf of a Minor (see Section 5); (c) automatically — through your use of the Site and cookies or similar technologies (see Section 11); and (d) from service providers — for example, information from our hosting or payment-related providers that helps us verify payments or operate the Service; and (e) from your school or its authorised coordinator where they invite you, assign classes or provide access through a school licence.
5. CHILDREN'S AND MINORS' DATA (PLEASE READ CAREFULLY)
5.1 The Service is intended to be contracted for by adults. A person under 18 ("Minor") may use the Service only where a parent or legal guardian ("Responsible Adult") has accepted the Terms of Service and consented, as set out in those Terms.
5.2 By allowing a Minor to use the Service, the Responsible Adult: (a) consents to our collection and use of the Minor's personal data as described in this policy; and (b) confirms they have authority to give that consent.
5.3 We rely on the Responsible Adult to provide and manage consent for the Minor and to supervise the Minor's use of the Service. We may request reasonable evidence of consent or of the Responsible Adult's authority.
5.4 We aim to collect only the personal data of Minors that is necessary to provide the Service. A Responsible Adult may exercise the access, correction and other rights in Section 14 on behalf of a Minor.
5.5 If you believe a Minor has provided us with personal data without the required consent, please contact us (Section 15) and we will take appropriate steps, which may include deleting the data or suspending the Account.
6. PURPOSES FOR WHICH WE USE PERSONAL DATA
6.1 We use personal data for the following purposes: (a) to create and manage your Account and provide the Service; (b) to process and verify payments through Stripe or manual PayMe/FPS, activate Pack access, reconcile transactions and handle refunds or disputes; (c) to provide, personalise and improve Content, AI Feedback and (where applicable) Tutor Review; (d) to operate free lesson previews, the limited free AI Study Partner allowance, the opt-in two-mark grading trial, and eligible paid AI essay feedback, including recording trial activation and usage to enforce account limits; (e) to provide AI Explain in a chosen language, and to arrange and deliver teaching, consultations and personal statement reviews, including quotes, payments, booking messages and online meeting links; (f) to administer school access and provide learning reports and saved work to school coordinators and assigned teachers; (g) to respond to enquiries and provide customer support; (h) to communicate with you about your Account, payments, activation, service updates, and changes to our terms or this policy; (i) to maintain the security, integrity and proper functioning of the Service, and to detect and prevent misuse, credential sharing, fraud and unauthorised access; (j) to keep records and to comply with our legal and regulatory obligations; and (k) where permitted, for direct marketing as described in Section 8.
6.2 We will not use your personal data for a new purpose that is unrelated to the purposes above without your consent, except where permitted or required by law, consistent with the PDPO.
7. AI LEARNING TOOLS AND YOUR SUBMISSIONS
7.1 When you use AI Study Partner, AI Explain or AI essay feedback, we process your question, selected passage or submitted essay, together with relevant learning materials, to generate the requested response. We may store conversation or feedback history where the feature provides that history.
7.2 To provide these features, the relevant input may be processed by our automated systems and Google Cloud's Vertex AI acting on our behalf. Processing may occur outside Hong Kong. We require providers acting for us to handle data under appropriate confidentiality and data-protection obligations.
7.3 We may store submissions and the feedback generated in order to provide the Service, display your history, support you, and maintain the quality and security of the Service.
7.4 We do not use your submissions to train or improve any artificial- intelligence model, and we do not provide them to a provider for model training. The provider may process or retain limited data for service security or abuse monitoring under its applicable terms.
7.5 Please do not include in your submissions any sensitive personal information that is not necessary for the requested feature. AI explanations, chat and essay feedback are automated guidance only, as explained in the Terms of Service.
8. DIRECT MARKETING
8.1 We will only use your personal data for direct marketing (for example, emails about new Packs, offers or updates) where this is permitted under the PDPO, including Part 6A of the PDPO.
8.2 Before using your personal data in direct marketing, we will, where required, notify you and obtain your consent. The kinds of personal data that may be used are your name and contact details, and the marketing may relate to our study products and services.
8.3 You can opt out of direct marketing at any time, free of charge, by using the unsubscribe link in our messages or by contacting us (Section 15). We will stop using your data for direct marketing once we action your request.
9. DISCLOSURE AND SHARING OF PERSONAL DATA
9.1 We do not sell your personal data.
9.2 We may disclose personal data to: (a) SERVICE PROVIDERS who help us operate the Service, such as hosting, IT, communications, payment-related and AI-feedback providers, who are authorised to use data for the services they provide. Payment providers may also process data for their own fraud-prevention, regulatory and legal purposes under their privacy notices; (b) PROFESSIONAL ADVISERS, such as our lawyers and accountants, where reasonably necessary; (c) AUTHORITIES OR THIRD PARTIES, where required or permitted by law, to comply with legal process, to enforce our terms, or to protect our rights, the Service, or the safety of users; and (d) A SUCCESSOR ENTITY, in connection with a merger, acquisition or transfer of our business, subject to appropriate protections; and (e) YOUR SCHOOL, its authorised coordinators and assigned teachers, when school access is provided and the information is needed to administer classes, view learning progress or provide feedback. The school is separately responsible for its own use of copies it receives.
9.3 We require those who process personal data on our behalf to protect it and to use it only for the purposes we permit.
10. TRANSFERS OF PERSONAL DATA OUTSIDE HONG KONG
10.1 Because we use service providers and because the Service is available internationally, personal data may be processed or stored outside Hong Kong.
10.2 Where personal data is transferred outside Hong Kong, we will take reasonable steps consistent with the PDPO and applicable guidance from the Office of the Privacy Commissioner for Personal Data to protect it, which may include using contractual protections with the recipients.
10.3 If you access the Service from outside Hong Kong, you understand that your personal data will be handled as described in this policy and may be processed in Hong Kong and other locations.
11. COOKIES AND SIMILAR TECHNOLOGIES
11.1 We use cookies and similar technologies to operate the Site, keep you signed in, remember preferences, maintain security, and understand how the Service is used.
11.2 Some cookies are necessary for the Service to function and others support features such as remembering your preferences. You can usually control cookies through your browser settings, although disabling some cookies may affect how the Service works.
11.3 OPTIONAL ANALYTICS. With your permission, we use Google Analytics to understand visits, traffic sources, device types, approximate regions and actions such as registrations and purchases. Google processes usage data and a browser cookie identifier, and data may be processed outside Hong Kong. We do not send Google Analytics your name, email, account ID, essays, chat messages or form contents. Purchase reporting uses an opaque order identifier, Pack identifiers, currency and amount; this is separate from the records needed to fulfil your order.
11.4 Analytics is off until you choose Allow analytics. Choose Essential only to continue without it, or use Cookie choices to withdraw permission. Your choice is remembered for up to six months, and Google Analytics cookies are configured for up to six months. Withdrawing permission stops future collection and removes those cookies from this browser; it does not erase previously collected reports. Advertising personalisation and Google signals are disabled. Google's privacy policy is at https://policies.google.com/privacy. Contact learn@daniellenglish.com with privacy questions.
12. SECURITY OF PERSONAL DATA
12.1 We take reasonably practicable steps to protect personal data against unauthorised or accidental access, processing, erasure, loss or use, having regard to the nature of the data and the harm that could result.
12.2 These steps may include access controls, secure storage of credentials, and limiting access to personal data to those who need it to provide the Service. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12.3 You are responsible for keeping your login credentials confidential and for not sharing access to your Account.
13. ACCURACY AND RETENTION
13.1 We take reasonably practicable steps to keep personal data accurate. Please keep your Account information up to date and tell us about any changes.
13.2 We keep personal data only for as long as is necessary to fulfil the purposes for which it was collected, including to provide the Service, handle disputes and keep records required by law. Retention varies by record: an active account and its learning history may remain while the account is in use; payment and legal-consent records may need to be retained after account closure. When personal data is no longer required, we take reasonably practicable steps to erase it or to stop it being used to identify you. Contact us to request account closure or ask about retention of a particular record.
14. YOUR RIGHTS (ACCESS AND CORRECTION)
14.1 Under the PDPO, you have the right to: (a) ask whether we hold personal data about you; (b) request access to a copy of your personal data; and (c) request correction of your personal data if it is inaccurate.
14.2 A Responsible Adult may exercise these rights on behalf of a Minor.
14.3 To make a data access or correction request, contact us using the details in Section 15. We may need to verify your identity, and we may charge a reasonable fee for complying with a data access request as permitted by the PDPO. We will respond within the time required by the PDPO (currently 40 days).
14.4 You may also withdraw consent to direct marketing at any time (Section 8). Where you withdraw a consent, this does not affect the lawfulness of processing carried out before the withdrawal.
15. HOW TO CONTACT US / DATA PROTECTION CONTACT
15.1 For any question about this policy or about how we handle personal data, or to make a request under Section 14, please contact:

16.2 You also have the right to make a complaint to the Office of the Privacy Commissioner for Personal Data, Hong Kong (PCPD), which oversees the PDPO.
17. THIRD-PARTY SITES
17.1 The Site or Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. Please review their privacy policies before providing them with personal data.

18.1 We may update this policy from time to time. We will post the updated policy on the Site and update the "Last updated" date, and, where the changes are material, we will take reasonable steps to notify you.

Refund Policy
*Version 1.3 · Last updated: 5 October 2026*
1. Introduction
This Refund Policy applies to one-time purchases of standard 12-month access or the optional 14/30-day Taster access shown at checkout for digital study packs and related digital learning features (“Study Packs”) made through daniellenglish.com. The Service is operated by Danielle Lam in her individual capacity as Between the Lines with Danielle (“we”, “us”, or “our”).
Separately quoted live teaching, consultations and personal statement reviews are services rather than Study Pack purchases. Their agreed quote and any cancellation conditions shown before payment govern those services, subject to rights that cannot be excluded by law. Contact us promptly if a session must be changed or a promised service is not delivered. This Study Pack policy does not by itself make a paid teaching or review service non-refundable.
By purchasing a Study Pack, you agree to this Refund Policy. This Refund Policy forms part of, and should be read together with, our Terms of Service and Privacy Policy.
2. Free Preview Before Purchase
Available free lesson previews and homepage demonstrations let you explore the learning approach before purchase. Check the selected Pack description for its included content and available samples.
You are encouraged to review available previews and the Pack description before purchasing. Previews do not include every paid feature. Verified free accounts can explicitly opt in to two personal AI essay feedback trials in total; these trials do not unlock paid Pack content.
3. Nature of the Product
Study Packs are digital educational products. Stripe card payments activate access automatically after successful payment confirmation reaches our system. PayMe/FPS payments require manual confirmation, normally within 8–12 hours of receiving the payment and matching details. Contact us if you have been charged but access is missing.
Because the product is digital and the purchased content becomes accessible once activated, fees are non-refundable after access has been granted, except where a refund is expressly provided under this Refund Policy or required by applicable law.
4. Circumstances Where Refunds May Be Provided
We will provide a refund of the Study Pack fee in the following circumstances:
(a) Technical or system failure attributable to us Where a technical fault, system error, or access failure attributable to us prevents you from accessing the Study Pack you paid for, and we are unable to restore your access within a reasonable period after you notify us.
(b) Study Pack not provided Where your payment has been confirmed but the Study Pack you purchased is not made available to your account.
(c) Duplicate or erroneous charge Where you have been charged more than once for the same subscription, or where you have been charged in error.
(d) Other circumstances required by law Where applicable law requires a refund, remedy, or other form of redress.
Where possible, approved refunds will be made to the original payment method. If the original payment method is unavailable or impracticable, we may arrange an equivalent refund method.
5. Circumstances Where Refunds Are Not Provided
Except as required by applicable law or as set out in Section 4, refunds are not provided in the following circumstances:
(a) you change your mind after purchase; (b) you decide that you no longer need the Study Pack; (c) you did not access, or only made limited use of, the Study Pack after purchase; (d) you did not review the free preview before purchasing; (e) the Study Pack does not match your personal preference, learning style, examination plan, syllabus choice, or study schedule, provided that the Study Pack was made available as described; (f) you purchased the wrong Study Pack or used the wrong account, unless we agree otherwise at our discretion before substantial access or use has occurred; (g) your access issue is caused by your device, internet connection, browser settings, third-party software, or other circumstances outside our reasonable control; (h) your access is suspended, restricted, or terminated because you have breached our Terms of Service.
6. No Partial Refunds for Unused Time
Unless required by applicable law or approved under Section 4, we do not provide partial refunds for unused subscription time.
For example, if you stop using a Study Pack before the end of your subscription term, you will not be entitled to a refund for the remaining period.
7. Subscription Term and Renewal
Study Pack subscriptions last for twelve (12) months from the date access is granted, unless a different term is clearly stated at the time of purchase.
Subscriptions do not renew automatically. We do not charge you automatically at the end of the subscription term. When your subscription expires, your access to the paid Study Pack will end unless you choose to purchase a new subscription.
This applies to Stripe card payments as well as PayMe/FPS: one payment for the access period shown at checkout, with no automatic renewal. Optional paid Tasters last 14 or 30 days. Their eligible upgrade credit is a reduction in the same Pack’s 12-month upgrade price under Section 6.5 of the Terms of Service, rather than a cash refund. The refund exceptions and non-excludable rights in this policy continue to apply to Tasters and upgrades. You must choose to purchase again to renew access.
8. Purchasers Who Are Minors
The Service is intended to be purchased by adults, including parents, guardians, teachers, or other responsible users.
Where a Study Pack is purchased by, or for the use of, a person under the age of 18, the purchase is made on the basis that a parent or guardian has consented to the purchase, the use of the Service, and the applicable terms.
Any approved refund relating to such a purchase will normally be made to the original payment method or, where appropriate, handled with the parent or guardian.
9. How to Request a Refund
To request a refund under this Refund Policy, please contact us at [learn@daniellenglish.com](mailto:learn@daniellenglish.com) and provide:
(a) the email address associated with your account; (b) the payment reference, receipt, or transaction details; (c) the name of the Study Pack purchased; and (d) a clear description of the issue.
We may ask for additional information reasonably required to verify the purchase, investigate the issue, and process the request.
We aim to acknowledge refund requests within five (5) working days and to resolve valid refund requests within fourteen (14) working days after we have received the information reasonably required to assess the request.
For the purposes of this Refund Policy, “working day” means a day other than a Saturday, Sunday, or public holiday in Hong Kong.
10. Our Right to Restore Access Before Refund
Where the issue relates to access, login, or technical availability, we may first attempt to restore access or provide a reasonable technical solution.
For a technical or access failure under Section 4(a), a refund will normally be provided where the issue is attributable to us and we are unable to restore access within a reasonable period. This does not limit the separate grounds in Sections 4(b)–(d).
11. Chargebacks and Payment Disputes
If you believe a payment was made in error, please contact us first so that we can review and resolve the matter promptly.
If you initiate a chargeback or payment dispute without first contacting us, we may need to suspend access to the relevant Study Pack while the payment dispute is being reviewed.
Nothing in this section affects any right you may have under applicable law or under the rules of your payment provider.
12. Your Statutory Rights
Nothing in this Refund Policy excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified under the laws of the Hong Kong Special Administrative Region.
This includes, where applicable, rights or remedies under the Sale of Goods Ordinance (Cap. 26), the Supply of Services (Implied Terms) Ordinance (Cap. 457), the Trade Descriptions Ordinance (Cap. 362), the Control of Exemption Clauses Ordinance (Cap. 71), the Unconscionable Contracts Ordinance (Cap. 458), and any other applicable law.
If any part of this Refund Policy conflicts with such rights, the applicable statutory rights will prevail.
13. Changes to This Refund Policy
We may update this Refund Policy from time to time.
The version that applies to your purchase is the version presented when you accept the purchase terms. Updated versions will be identified by version number and date. A later change does not retrospectively remove a remedy for an earlier purchase.

TERMS OF SERVICE — "BETWEEN THE LINES WITH DANIELLE"
Version 1.3 · Last updated: 5 October 2026
IMPORTANT — PLEASE READ CAREFULLY. Standard Study Packs provide 12 months of access; optional paid Tasters provide the 14 or 30 days shown at checkout. Each is one payment with no automatic renewal. Our Refund Policy explains when refunds or other remedies are available (see Section 9). Explore available free lessons before purchasing. Limited free AI Study Partner chat and the homepage's written examples help you explore the learning experience; verified free accounts may opt in to two personal AI essay feedback trials in total; continued marking requires eligible Pack access (see Section 8).
1. ABOUT THESE TERMS AND ACCEPTANCE
1.1 These Terms of Service ("Terms") govern your access to daniellenglish.com (the "Site") and Between the Lines with Danielle, including free lessons, time-limited Study Packs, AI Explain, AI Study Partner, AI essay feedback, school access, live teaching, personal statement support and related services (together, the "Service"). Features and availability vary by product.
1.2 The Service is operated by Danielle Lam in her individual capacity under the name Between the Lines with Danielle ("the Operator", "we", "us" or "our"). You can contact us at learn@daniellenglish.com.
1.3 By creating an account, purchasing access, or otherwise accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms. Please also read our Privacy Policy, which explains how we handle personal data. If you do not agree to these Terms, you must not use the Service.
1.4 If you are entering into these Terms on behalf of a child under 18, you also agree to Section 3 (Eligibility and Minors) and you accept these Terms as the contracting party on that child's behalf.
1.5 These Terms form a legally binding agreement between you and the Operator. We may update them from time to time in accordance with Section 20.
2. DEFINITIONS
2.1 "Account" means the registered account used to access the Service.
2.2 "Content" means all materials made available through the Service, including text analysis and commentary, audio explanations, practice questions, model answers, AI-generated feedback, study packs, and any text, images, audio, software, branding and other materials.
2.3 "Pack" or "Study Pack" means a study product providing a time-limited licence to access its included materials for the period shown at purchase.
2.4 "Free Preview" means selected sample Content made available before purchase, as described in Section 8.
2.5 "Subscription" means a paid, time-limited licence to access a Pack. This term does not mean automatic billing or renewal.
2.6 "User", "you" or "your" means the person accessing the Service and, where the user is under 18, the parent or guardian who contracts on the child's behalf under Section 3.
3. ELIGIBILITY AND MINORS
3.1 The Service is used by students (who are often minors) and by parents and guardians, in Hong Kong and internationally.
3.2 Adults may register and purchase for themselves. A Minor may use an Account only with the consent and agreement of a Responsible Adult under Section 3.3. The Responsible Adult is the contracting party for a Minor's paid purchase.
3.3 USERS UNDER 18. A person under the age of 18 ("Minor") may register or use the Service only where a parent or legal guardian ("Responsible Adult"): (a) is at least 18 years old and is the contracting party under these Terms; (b) creates and is responsible for the Account, or expressly authorises and supervises its use by the Minor; (c) is responsible for all payments and for the Minor's compliance with these Terms; (d) consents to the Minor's use of the Service; and (e) consents to the collection and processing of the Minor's personal data as described in our Privacy Policy.
3.4 By allowing a Minor to use the Service, the Responsible Adult represents that they have the authority to give the consents in Section 3.3 and to bind the Minor to acceptable-use obligations under these Terms. We may, at our discretion, request reasonable evidence of consent or of the Responsible Adult's identity, and may suspend access until it is provided.
3.5 Educators or institutions registering on behalf of students must be authorised adults and are responsible for obtaining all necessary consents from students and their parents or guardians.
3.6 If we become aware that a Minor is using the Service without a Responsible Adult having accepted these Terms, we may suspend or close the relevant Account.
4. ACCOUNT REGISTRATION AND SECURITY
4.1 You must provide accurate, current and complete information when registering and keep it up to date.
4.2 Your Account is personal to a single User. You are responsible for keeping your login credentials confidential and for all activity that occurs under your Account.
4.3 You must not share, sell, transfer or allow any other person to use your Account or credentials. Each Subscription entitles one User to access the relevant Pack. Sharing access is a material breach of these Terms (see Sections 11 and 12).
4.4 You must notify us promptly at learn@daniellenglish.com if you suspect any unauthorised use of your Account.
4.5 We may suspend or disable an Account where we reasonably believe your credentials are being misused, shared, or accessed by an unauthorised person, or where required to protect the Service or other users.
5. THE SERVICE AND SUBSCRIPTIONS
5.1 Subject to these Terms and to payment of the applicable fees, we grant you access to the Pack(s) you have subscribed to for the duration of the relevant Subscription.
5.2 Subscriptions are offered on a per-Pack basis. The scope of each Pack (the Content included) is described on the Site at the time of purchase.
5.3 The Service is provided for personal, non-commercial study only. The licence to use the Content is set out in Section 11.
5.4 We may add, improve, update, modify, correct, or withdraw Content within a Pack from time to time, for example to keep materials current or to fix errors. We will use reasonable efforts not to materially reduce the core Content of a Pack you have paid for during your active Subscription term.
5.5 Where a school provides access, its coordinator controls invitations and class assignments. Teachers can view learning activity and saved work of students assigned to them. School access lasts only while the relevant school licence and your assignment remain active. A school licence is not a personal Pack purchase; any fees and school arrangements are agreed separately with the school.
6. SUBSCRIPTION TERM AND RENEWAL
6.1 A standard Subscription provides 12 months of access to the relevant Pack. Where offered, a paid Taster provides 14 or 30 days, as shown at checkout. Access begins on successful payment confirmation under Section 7 and continues for the purchased period, unless ended earlier under these Terms.
6.2 One payment provides the access period shown at checkout. Subscriptions do NOT auto-renew, including purchases paid by card through Stripe. Access ends at the end of the term unless you choose to purchase a new Subscription.
6.3 We will not start automatic renewal under these Terms. If we introduce an optional automatic-renewal service in future, its price, billing cycle and cancellation arrangements will be explained before you choose to opt in, and your agreement will be required.
6.4 Prices and Pack contents may change over time. Any change will not affect the price or scope of a Subscription you have already paid for during its current term.
6.5 TASTER AND UPGRADE. Taster availability, price, duration and any one-per-account limit are stated for each Pack. When repeat purchases are permitted, another Taster can be bought after existing access ends. During the current Taster’s validity, an upgrade to 12-month access for the same Pack credits its full eligible Taster payment against the current 12-month price. Only the latest, unrefunded and unused Taster payment qualifies; credits do not accumulate or combine with promo codes. Start the upgrade checkout before the Taster expires; the credit is then held for that checkout’s 35-minute payment window. The new 12-month period starts from the upgrade payment. The remaining amount is shown before payment. If the remaining amount cannot be processed at checkout, contact us for an adjusted quote before paying.
7. PRICING, PAYMENT AND ACTIVATION
7.1 Subscriptions are priced per Pack in Hong Kong Dollars (HKD). Current prices are shown on the Site. Unless stated otherwise, prices are inclusive of any applicable taxes.
Stripe may offer a local-currency payment option at checkout. If offered, the converted amount and applicable conversion information are shown before you confirm payment. Your bank or card issuer may charge its own fees.
7.2 PAYMENT METHODS. Credit and debit card payments are securely processed through Stripe-hosted Checkout. Apple Pay and Google Pay may be offered on eligible devices and browsers. PayMe and FPS are also available using the instructions provided at checkout. The payment methods available for your purchase are shown at checkout.
7.3 ACTIVATION. For Stripe payments, access is activated automatically after successful payment confirmation reaches our system; this can take a few moments. PayMe/FPS payments require manual verification, normally within 8–12 hours of receiving your payment and matching details; this is a target, not a guarantee. If you have been charged but cannot access your Pack, contact learn@daniellenglish.com before paying again.
7.4 You are responsible for making payment using the correct reference details and for any fees charged by your bank or payment provider. If we cannot match or verify your payment, activation may be delayed until the issue is resolved.
7.5 Once your payment is verified and access is activated, the full digital Content of the Pack becomes immediately accessible and viewable. Please read Section 9 and the Refund Policy before you pay.
7.6 ONE-TIME PAYMENT. Completing card checkout does not authorise an automatic renewal charge. Payment confirmation and Pack activation are separate from a bank authorisation or a pending charge. Any approved refund will normally be made to the original payment method, as described in our Refund Policy.
8. FREE PREVIEW AND AI DEMONSTRATIONS (TRY BEFORE YOU BUY)
8.1 Before purchase, you can read available free sample lessons without an account. A free, email-verified account provides two AI Study Partner questions per UTC day across Packs, using free pack content (reset at 00:00 UTC / 08:00 Hong Kong). Homepage AI examples are pre-written demonstrations. Verified free accounts may explicitly opt in from My Essays to two successful personal AI essay feedback trials in total per account, not per month or Pack. These trials use available free reference material and do not unlock paid Pack content. The marking form locks again once both trials are used unless you have eligible Pack access. Paid marking requires an active entitlement to an eligible Pack with marking enabled and remains subject to usage limits.
8.2 Free samples and demonstrations let you assess the learning approach before purchasing. They do not include every paid feature or every item of Content. Review the selected Pack description to check that it suits your course and needs.
8.3 The availability of the Free Preview helps you assess a Pack before paying. Refund eligibility is explained in Section 9 and the Refund Policy.
9. REFUNDS AND REMEDIES (PLEASE READ CAREFULLY)
9.1 Once access has been activated, fees are generally non-refundable because the purchased digital Content is made available to you. The exceptions in the published Refund Policy and any non-excludable rights remain applicable.
9.2 BEFORE PURCHASE. Review the Pack description, available Free Preview and the Refund Policy before paying. Free samples, written AI demonstrations and the limited opt-in grading trial described in Section 8 help you assess the product.
9.3 REFUND EXCEPTIONS. The published Refund Policy forms part of these Terms and governs refund requests, including technical or access failures attributable to us, a purchased Pack not being provided, duplicate or erroneous charges, and remedies required by applicable law. For access problems, we may first try to restore access as described in that policy. If these Terms and the Refund Policy conflict on refund eligibility, the Refund Policy applies, subject always to non-excludable rights.
9.4 To request a remedy under Section 9.3, contact us at learn@daniellenglish.com with your Account details, the Pack affected and a description of the problem, so that we have a reasonable opportunity to investigate and resolve it.
9.5 The following are NOT grounds for a refund: change of mind; not using the Content; finding the Content does not meet personal expectations or learning needs (which the Free Preview is designed to help you assess); your own device, software, browser or internet problems; loss of access caused by your breach of these Terms; or examination results.
9.6 NON-EXCLUDABLE RIGHTS PRESERVED. Nothing in this Section 9 excludes, restricts or modifies any right or remedy you may have that cannot be excluded, restricted or modified under applicable Hong Kong law (including any non-excludable implied terms as to the provision of services with reasonable care and skill). Where such rights apply, this policy operates only to the maximum extent permitted by law and in addition to (not instead of) those rights.
10. AI FEEDBACK FEATURE AND TUTOR REVIEW
10.1 The Service includes an automated feature that provides instant formative feedback on practice essays ("AI Feedback").
10.2 AI Feedback is automated guidance generated by software. It is intended to support your study and is NOT: (a) a guarantee or prediction of any examination result, grade or outcome; (b) marking by an examination board or an official assessment; or (c) a substitute for teaching or advice from a qualified teacher or tutor.
10.3 AI Feedback may contain errors, omissions or inaccuracies, and may not reflect the marking standards or expectations of any particular examination board. You should use AI Feedback as one study aid among others and exercise your own judgement. To the maximum extent permitted by law, we are not liable for any loss arising from reliance on AI Feedback (subject to Section 16).
10.4 You must not submit, through the AI Feedback feature, content that is unlawful, that infringes another person's rights, or that contains sensitive personal information that is not necessary for the feedback. How submissions are processed (including processing by third-party AI service providers) is described in our Privacy Policy.
10.5 TUTOR REVIEW. We may also offer a separate, optional human "Tutor Review" service, which may be subject to additional terms, fees, turnaround times and availability stated at the point of purchase. Tutor Review provides educational feedback only and is not an official assessment or a guarantee of any result.
10.6 NO OUTCOME GUARANTEE. We do not warrant or guarantee that using the Service (including any Content, AI Feedback or Tutor Review) will result in any particular examination grade, mark, qualification or other outcome. Results depend on many factors outside our control.
10.7 AI EXPLAIN AND STUDY PARTNER. These features can explain a selected passage or answer a question in a chosen language. Their responses are generated by AI and may be inaccurate or incomplete. Keep the English source alongside the explanation and check important meanings against the original and your teacher's guidance. A language explanation is a study aid, not a certified translation. Usage limits and access conditions are shown in the Service.
10.8 LIVE TEACHING AND PERSONAL STATEMENT SUPPORT. A request is not a confirmed booking or order. We review requests, agree the scope, fee and (for a session) date and time, then issue a quote for your acceptance. Payment and our confirmation establish the paid service. Online sessions normally use Zoom; meeting details may be sent through the private booking message board. Please keep messages relevant to the service and do not use it for emergencies requiring immediate assistance. Any rescheduling, cancellation or refund conditions shown with your quote apply alongside our non-excludable legal obligations. A review or consultation provides educational guidance, not an admissions outcome guarantee.
11. INTELLECTUAL PROPERTY AND LICENCE TO USE
11.1 OWNERSHIP. All intellectual property rights in the Service and the Content (including the text analysis and commentary, audio explanations, practice questions, model answers, AI Feedback formats, study packs, software, design, look and feel, "Between the Lines with Danielle" branding, logos and names) are owned by, or licensed to, the Operator and its licensors. The Content is protected by copyright and other laws in Hong Kong and elsewhere.
11.2 LIMITED LICENCE. Subject to your compliance with these Terms and payment of applicable fees, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Content of the Pack(s) you have subscribed to, solely for your own personal, non-commercial study, for the duration of your Subscription.
11.3 RESTRICTIONS. Except as expressly permitted by the Service's functionality or by us in writing, you must NOT (and must not permit or assist any other person to): (a) copy, reproduce, download, store, print or save Content beyond what the Service expressly allows for your personal study; (b) share, distribute, publish, transmit, broadcast, upload, post, sell, rent, lend, sublicense or otherwise make any Content available to any other person; (c) screen-record, screenshot, photograph or otherwise capture Content for the purpose of distributing or sharing it; (d) share Account access or login credentials, or use the Service to provide a service to third parties; (e) modify, adapt, translate or create derivative works from the Content; (f) remove, obscure or alter any copyright, trademark or other proprietary notice; (g) use any robot, scraper, crawler, data-mining or automated means to access, extract or copy Content; (h) use the Content or the Service to develop, train or build any competing product or service, or to train any machine-learning or AI model; or (i) reverse engineer, decompile or attempt to derive the source code of any software forming part of the Service, except to the extent this restriction is prohibited by law.
11.4 RESERVATION OF RIGHTS. All rights not expressly granted to you are reserved by the Operator and its licensors. No right or licence is granted by implication.
11.5 THIRD-PARTY AND SET-TEXT MATERIALS. The Service relates to IGCSE set texts and other works whose own copyright may belong to third parties. The Operator's intellectual property subsists in its own original analysis, commentary, audio, questions and materials. Any third-party materials are used only as permitted by law or under licence.
11.6 FEEDBACK TO US. If you send us suggestions or feedback about the Service, you grant us a free, perpetual and irrevocable right to use them without obligation to you.
11.7 INFRINGEMENT AND TAKEDOWN. If you believe any Content infringes your rights, contact us at learn@daniellenglish.com with details so we can investigate and, where appropriate, remove or address the material.
11.8 CONSEQUENCES OF MISUSE. Unauthorised copying or sharing of Content is a serious breach of these Terms and may infringe our or our licensors' rights. We may suspend or terminate your access without refund (see Sections 9 and 14) and pursue any available legal remedies.
12. ACCEPTABLE USE
12.1 You agree to use the Service lawfully and in accordance with these Terms. In addition to Section 11.3, you must NOT: (a) use the Service for any unlawful, fraudulent or harmful purpose; (b) attempt to gain unauthorised access to any part of the Service, other accounts, or our systems or networks; (c) introduce viruses, malware or other harmful code, or interfere with, disrupt or place an unreasonable load on the Service; (d) circumvent, disable or interfere with any security, access-control or usage-limit feature of the Service; (e) impersonate any person, or misrepresent your identity, age or affiliation; (f) submit content that is unlawful, defamatory, obscene, harassing, infringing or otherwise objectionable; or (g) use the Service in any way that breaches the rights of, or restricts the use of the Service by, any other person.
12.2 We may investigate suspected breaches and take any action we consider appropriate, including removing content, suspending or terminating access, and reporting to relevant authorities.
13. AVAILABILITY OF THE SERVICE
13.1 We aim to keep the Service available but do not guarantee that it will be uninterrupted, error-free or available at all times. Access may be affected by maintenance, updates, technical issues, or events beyond our control.
13.2 We may suspend, withdraw, restrict or change all or any part of the Service for operational, legal or security reasons. Where reasonably practicable we will give notice.
13.3 You are responsible for arranging the device, software, browser and internet connection needed to access the Service, and for any related costs.
13.4 Section 9 and the Refund Policy explain the remedies available for technical or access failures, subject to your non-excludable rights.
14. SUSPENSION AND TERMINATION
14.1 BY YOU. You may stop using the Service at any time and may choose not to renew. Closing your Account or stopping use does not entitle you to a refund except as provided in Section 9.
14.2 BY US. We may suspend or terminate your Account or access to the Service, in whole or in part, with or without notice, if: (a) you breach these Terms (including Sections 4, 11 and 12); (b) we reasonably suspect misuse, credential sharing, or unauthorised access; (c) payment is not received or cannot be verified; or (d) we are required to do so by law or to protect the Service or others.
14.3 If we terminate your access because of your material breach, you will not be entitled to any refund, and any outstanding fees remain payable.
14.4 EFFECT OF TERMINATION. On termination, your licence to use the Content ends and you must stop using and (where applicable) delete any Content you hold outside the Service. Sections that by their nature should survive (including Sections 9, 11, 15, 16, 17, 19, 22 and 23) will continue to apply.
15. DISCLAIMERS
15.1 To the maximum extent permitted by law, and subject to Sections 9.6 and 16.2, the Service and Content are provided on an "as is" and "as available" basis, and we make no warranties, conditions or representations of any kind, whether express or implied, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement, except as cannot be excluded under applicable Hong Kong law.
15.2 We do not warrant that the Content (including AI Feedback) is accurate, complete, current, or aligned with the requirements or marking standards of any examination board, or that it will meet your particular learning needs or result in any particular outcome.
15.3 The Service provides educational study support only. It does not provide, and must not be relied upon as, professional, legal, examination, or other specialist advice.
15.4 We will provide the Service with reasonable care and skill as required by applicable Hong Kong law. Nothing in this Section limits that obligation or any other right that cannot be excluded by law.
16. LIMITATION OF LIABILITY
16.1 Subject to Section 16.2, and to the maximum extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, opportunity, goodwill, data, or examination results or outcomes, however arising; (b) we will not be liable for matters outside our reasonable control, including your device, software, browser or internet issues, or third- party services; and (c) our total aggregate liability arising out of or in connection with these Terms and the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the fees you paid for the product or service giving rise to the claim in the 12 months before the event giving rise to liability.
16.2 NON-EXCLUDABLE LIABILITY. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes any liability that cannot be excluded or limited under applicable Hong Kong law, such as liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, and any liability under non-excludable provisions (including, where applicable, the Control of Exemption Clauses Ordinance (Cap. 71) and the Supply of Services (Implied Terms) Ordinance (Cap. 457)).
16.3 Any exclusion or limitation in these Terms applies only to the extent it is reasonable and permitted under applicable Hong Kong law.
16.4 You agree that the allocation of risk in these Terms (including the pricing, the Free Preview, and the limitations in this Section) is reasonable.
17. INDEMNITY
17.1 To the maximum extent permitted by law, you agree to indemnify and hold harmless the Operator and its officers, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal costs) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Service or Content (including unauthorised copying, sharing or distribution); or (c) your infringement of any third-party right. This Section does not apply to the extent a loss is caused by our own breach or negligence.
18. THIRD-PARTY SERVICES AND LINKS
18.1 The Service may rely on or link to third-party services (for example, payment providers, hosting, and AI service providers). We are not responsible for third-party services or websites, which are governed by their own terms.
18.2 Your use of payment services (including Stripe, PayMe and FPS) is subject to the terms and privacy notices of the relevant provider.
19. PRIVACY AND DATA PROTECTION
19.1 We handle personal data in accordance with our Privacy Policy and the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. Please read the Privacy Policy to understand how we collect and use personal data, including data of Minors and data submitted through the AI Feedback feature.
20. CHANGES TO THESE TERMS
20.1 We may update these Terms from time to time, for example to reflect changes to the Service, to payment methods, or to legal requirements.
20.2 We will post the updated Terms on the Site and update the "Last updated" date, and, where the changes are material, we will take reasonable steps to notify you (for example by email or an on-Site notice).
20.3 Changes apply from the date the updated Terms are posted (or any later date stated). Where we ask you to accept an updated version before accessing your Account, you must do so to continue using the protected Service. Changes will not retrospectively affect the price or scope of a Subscription you have already paid for during its current term.
21. EVENTS BEYOND OUR CONTROL (FORCE MAJEURE)
21.1 We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including internet or hosting failures, power outages, acts of government, natural disasters, or third-party service failures. Section 9.3 continues to govern technical-failure remedies.
22. GENERAL
22.1 ENTIRE AGREEMENT. These Terms, the applicable Refund Policy and any specific accepted quote or school agreement govern the relevant Service. They replace prior agreements on the same subject, except where the parties expressly agree otherwise in writing. The Privacy Policy explains our data practices and is not intended to waive your privacy rights.
22.2 SEVERABILITY. If any provision is found to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be modified to the minimum extent necessary to make it valid while preserving its intent.
22.3 NO WAIVER. Our failure to enforce any provision is not a waiver of our right to do so later.
22.4 ASSIGNMENT. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer ours to an affiliate or in connection with a business transfer, provided your rights are not materially prejudiced.
22.5 THIRD-PARTY RIGHTS. Except that our officers, employees and agents may rely on Sections 16 and 17, a person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any of these Terms.
22.6 NOTICES. We may give notices to you by email to the address linked to your Account or by posting on the Site. You may contact us at learn@daniellenglish.com.
22.7 LANGUAGE. These Terms are written in English. Any translation is provided for convenience only; the English version prevails.
23. GOVERNING LAW AND JURISDICTION
23.1 These Terms and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes) are governed by the laws of the Hong Kong Special Administrative Region.
23.2 INFORMAL RESOLUTION FIRST. Before starting formal proceedings, we encourage you to contact us at learn@daniellenglish.com so we can try to resolve the matter.
23.3 The courts of the Hong Kong Special Administrative Region have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the Service.
